Acceptance of Terms

By creating an account, accessing the platform, using the API, AI-powered features, MCP integrations, SDKs, or otherwise using any part of the OriginalVoices service (collectively, the "Services"), you agree to be bound by these Terms.

If you do not agree, you must not use the Services.

1. Overview

These Terms apply to all use of the OriginalVoices Services, including the web platform (self-serve), API, SDKs, MCP integrations, and any associated tools or documentation.

Additional policies referenced in these Terms form part of this agreement.

2. Accounts and Access

To use the Services, you must:

  • Be 18 or older
  • Provide accurate information
  • Keep passwords, API keys, and credentials secure

You are responsible for all activity under your account, including where actions are taken by:

  • Employees
  • Contractors
  • Service providers
  • AI agents or automated tools operating via API or MCP

We may disable accounts that violate these Terms or present a security risk.

3. Acceptable Use

You may only use the Services for lawful business purposes and in line with your plan.

You must not:

  • Upload, generate, or request unlawful, harmful, hateful, discriminatory, violent, or sexually explicit content
  • Attempt to identify individuals or infer personal data from anonymised or aggregated outputs
  • Share account access, bypass security controls, exceed usage limits, or interfere with system performance
  • Use bots, automation, or scripts outside approved rate limits

We may suspend or restrict access if necessary to protect performance, security, or compliance.

4. Data Model and Privacy

OriginalVoices provides insights from Digital Twins of real people derived from our consumer application, Twineo.

The data made available to you does not include personal or personally identifiable data.

You must not attempt to identify individuals.

5. AI Features

Some features of the Services use artificial intelligence models ("AI Features").

You may submit inputs ("AI Inputs") and receive generated responses ("AI Outputs").

You agree that:

  • AI Outputs may include probabilistic or incomplete information
  • AI Outputs should not be treated as professional, factual, legal, financial, medical, or diagnostic advice
  • You are responsible for verifying AI Outputs before applying or acting on them

You must not submit:

  • Personal data
  • Sensitive or confidential business information
  • Protected category data
  • Any input relating to identifiable individuals

We may use non-personal AI Inputs and AI Outputs to train or improve the Services.

You retain ownership of your AI Inputs. You own the AI Outputs we generate for you, subject to these Terms.

We own the models and underlying systems that generate AI Outputs.

6. Sensitive and Restricted Topics

You may not use the Services to request content about:

  • Explicit sexual behaviour
  • Violence or harm
  • Political persuasion or profiling
  • Targeted questions to identify individuals
  • Detailed medical, biometric, or health-related content beyond permitted wellness categories

We may restrict responses or suspend access for ongoing violations.

7. Billing, Credits & Subscriptions

  • We may offer free trial credits. These credits expire weekly and do not rollover.
  • Paid plans renew automatically unless cancelled before the renewal date.
  • Billing is processed through Stripe.
  • For monthly plans, unused credits rollover for 1 month before expiring. For annual plans, unused credits rollover and expire at the end of the annual billing period.
  • Payments are non-refundable except where required by law.
  • Downgrades or cancellations take effect at the end of the current billing cycle.
  • If payment fails, we may suspend access.

8. Ownership and Licensing

You own:

  • Your Inputs
  • Your Outputs generated via the Services (subject to these Terms)

We own:

  • The platform, technology, AI models, and systems.

You may use exported insights commercially provided you:

  • Do not re-identify individuals
  • Attribute externally published insights as: "Source: OriginalVoices"

9. Service Availability

We aim for 99.9% availability, excluding:

  • Planned maintenance
  • Emergency security maintenance
  • Events outside our control

We will provide reasonable notice for scheduled downtime where possible. We are not responsible for outages caused by third-party networks or infrastructure.

10. Confidentiality

Each party agrees to keep confidential information secure and only use it where necessary to operate the Services.

This obligation survives termination.

11. Termination

You may cancel at any time.

If you delete your account while an active subscription is in place, your subscription will be cancelled immediately and you will not be billed again. You will retain access to the service until the end of your current billing period unless you choose to terminate access immediately.

Subscription fees are non-refundable, including for partial billing periods or unused service time.

Upon account deletion, all associated data will be permanently removed, except where retention is required for billing, tax, compliance, or audit purposes.

We may suspend or terminate access if:

  • You violate these Terms
  • You fail to pay fees
  • Your usage harms platform stability or security

You retain ownership of Outputs generated before termination.

12. Disclaimers

The Services and all Output Data are provided "as is" without warranties.

We do not guarantee accuracy, completeness, or suitability for any purpose.

You are responsible for evaluating and verifying Outputs.

13. Limitation of Liability

To the extent permitted by law:

  • Our maximum liability is limited to fees paid in the previous 6 months
  • We are not responsible for indirect, incidental, or consequential losses

Nothing limits liability for fraud or death/personal injury caused by negligence.

14. Changes to Terms

We may update these Terms.

We will provide notice at least 30 days before changes take effect.

Continued use constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of England and Wales. Courts in England and Wales have exclusive jurisdiction over disputes.
